1. Acceptance of Terms

By accessing or using Thetanium ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using Thetanium, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Description of Service

Thetanium provides AI-powered smart contract security analysis services. Our platform uses multi-agent large language models (LLMs) combined with retrieval-augmented generation (RAG) technology to analyze smart contract code for potential security vulnerabilities.

The Service includes:

• Automated vulnerability scanning of smart contract source code (supporting Solidity/EVM and Rust/Anchor/Solana, with Move coming soon)
• Detection of common vulnerabilities including reentrancy, access control issues, integer overflow/underflow, and more
• AI-generated recommendations for remediation
• Scan history and reporting features
• API access for programmatic integration (where available)

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your account information is accurate and up-to-date

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Acceptable Use

You agree NOT to use the Service to:

• Submit code that you do not have the right to analyze
• Upload malicious code intended to harm our systems or other users
• Attempt to reverse engineer, decompile, or disassemble our analysis algorithms
• Use the Service for any illegal purpose or in violation of any laws
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to the Service or its related systems
• Resell, redistribute, or sublicense access to the Service without authorization
• Use automated scripts or bots to access the Service beyond normal API usage

5. Intellectual Property

Your Code: You retain all ownership rights to the smart contract code you submit for analysis. By submitting code, you grant Thetanium a limited, non-exclusive license to process and analyze the code solely for the purpose of providing the Service.

Our Technology: The Service, including our multi-agent analysis system, RAG knowledge base, algorithms, user interface, and all related intellectual property, remain the exclusive property of Thetanium. These Terms do not grant you any rights to use our trademarks, logos, or branding.

Analysis Results: The vulnerability reports and recommendations generated by our Service are provided for your use. You may share these results at your discretion.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THETANIUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Financial losses resulting from vulnerabilities not detected by our Service
• Damages resulting from hacks, exploits, or security breaches of your smart contracts
• Business interruption or loss of business opportunities
• Any other damages arising from the use or inability to use the Service

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to Thetanium in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Thetanium and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, violation of these Terms, or violation of any rights of a third party.

9. Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Delaware.

12. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will notify users of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
